Samuel W Carhart's } In the name of God Amen. I Samuel W.
Will } Carhart of the township of Raritan
County of Monmouth and State of
New Jersey being of sound mind, memory and understanding (for which blessing I thank God) do make and publish this my last Will and Testament in manner following, that is to say:
First It is my will, and I do order, that all my just debts and funeral expenses be duly paid and satisfied as soon as conveniently can be after my decease.
Item I give and devise unto my son Timothy Carhart my undivided two thirds part of the blacksmith and wheelwright shop and the lot on which they stand situate at Mechanicsville and now occupied by him, to him his heirs and assigns forever.
Item I give and devise unto my son Joel Carhart and daughter Emeline Carhart all that lot of land lying on the northerly side of the road leading from Keyport to Middletown, bounded on the East by Joseph Carhart on the south by said road on the West by Leonard Bedle and on the north by William Vandine. It being a lot cut off from my homestead farm by said road to their heirs and assigns forever.
Item I give and bequeath unto my said son Joel Carhart and Emeline Carhart two hundred and fifty dollars each, to be paid to them as soon as the money comes to hand by my executors hereinafter named and also each one good feather bed and bedding.
Item I give and bequeath unto my son Samuel B. Carhart my team of cream colored horses, one farm wagon and dump body, and hay shelvings, now in his possession & used by him. Also two hundred and fifty dollars to be paid to him as soon as the money comes to hand by my executors.
Item I give and bequeath unto my daughter Emeline one set of silver tea spoons marked S.B. and to my son Joel one set of silver tea spoons marked E.C. and to my son Samuel B. one set of silver tea spoons marked M.C. which aforesaid devises and bequests in my opinion puts my said children upon an equality.
Item I do order and direct my executors hereinafter named to sell and convey in fee simple at such times and in such manner and for such prices as they shall deem proper, all my real estates whatsoever and whensoever except what is devised aforesaid and execute good & sufficient titles for the same, and after paying the aforesaid legacies, my just debts and all expenses incurred in settling my estate, and such expenses, as I may charge upon my estate by this will, to pay the whole proceeds thereof and the proceeds of my personal property, to my said children Timothy Carhart, Samuel B. Carhart, Joel Carhart and Emeline Carhart or their legal representatives equally share and share alike, which said proceeds, I do give and bequeath unto my said children Timothy, Samuel B., Joel and Emeline.
Item In case I do not remove my children who are buried in the old Walling burying ground unto my lot in Raritan Cemetery I do order my executors to do so & charge the expense thereof to my estate.
Item I do order and direct my executors to erect or cause to be erected a good and substantial fence around my lot in said cemetery, to be composed of Granite or marble posts with iron rails or chains as my be best considered by my executors, and charge the same to my Estate.
Item And further, as I have endorsed somewhat for my said son Timothy I do order by executors to claim and keep back all monies that my be coming to him, until he shall have paid the same or fully released any estate from all liability thereto, to the satisfaction of my said Executors. Lastly I hereby appoint my sons Timothy Carhart and Samuel B. Carhart and my friend Alfred Walling executors of this my last will and Testament and guardians to my children during their minority. In testimony whereof I have hereto set my hand & seal this twenty-fourth day of August A.D. Eighteen hundred and fifty-seven.
