Take notice, that upon reading and filing the petition of Henry Ellinghausen praying that the instrument filed in said court, on the 21st day of June, 1912, and purporting to be the last Will and Testament of Henry Muller, deceased, may be proved, probated, allowed and recorded as the last will and testament of said deceased, and that the execution of said instrument and the administration of said estates may be granted to Henry Ellinghausen as executor.
It is ordered, that said matter be assigned for hearing the 15th day of July, 1912, at one o'clock P. M., before said County Court, in West Point, Nebraska, at which time all persons interested in said estate, may appear and show cause why the prayer of said petitioner should not be granted.

In the matter of Proving the Last Will and Testament of Henry Muller late of said County, deceased.
Now comes F. D. Hunker who being duly sworn and examined as a witness on behalf of the petitioner, to prove said last well and testament, says that he resides in the City of West Point in the County of Cuming and State of Nebraska that he was acquainted with Henry Muller late of Cuming Township in Cuming County, Nebraska, deceased, in his lifetime; that the said Henry Muller at the time of, and for a long time immediately previous to his decease, was a resident of Cuming County aforesaid; that said Henry Muller departed this life at his home aforesaid, on or about the 16th day of June A. D. 1912, that he, the said F. D. Hunker is on of the subscribing witnesses to the instrument now on file in this Court, and shown to him, purporting to be the last will and testament of the said Henry Muller that on the 4th day of April A. D. 1912, in the Township of Cuming in the County and State of Nebraska he the said F. D. Hunker saw the said Henry Muller sign and seal the said instrument; that the said instrument was signed and sealed in the presence of Henry Ellinghausen the other subscribing witness thereto; that the said Henry Muller then and there, in the presence of him, the said F. D. Hunker and in the presence of the said Henry Ellinghausen published and declared the said instrument to be his last will and testament; that the said Henry Muller then and there requested him, the said F. D. Hunker and the said Henry Ellinghausen to subscribe their names to said instrument as witnesses thereto; that they the said F. D. Hunker and Henry Ellinghausen did thereupon, then and there, in the presence of the said Henry Muller and in presence of each other, subscribe their names to said instrument as witnesses thereto.
And the said F. D. Hunker further says that the said Henry Muller at the time he signed sealed, published and declared the said instrument as aforesaid, was above the age of twenty-one years; and, according to the discernment of him, the said F. D. Hunker of sound mind, and under no restraint whatever.

In the matter of proving the last will and testament of Henry Muller late of said County, deceased.
Now on this 15th day of July 1912, this cause came on for hearing, and it appearing to me, from the proof on file, that all proper parties to this proceeding have been duly notified; whereupon F. D. Hunker and Henry Ellinghausen subscribing witnesses to said instrument were sworn and examined and their affidavits filed.
On consideration whereof, I find that said will was duly executed by the said Henry Muller as required by the law of the State of Nebraska. That the said testator, at the time of making said will, was of full age, of sound mind and memory, and not under restraint, and was in all respects competent to devise real and personal estate; and that said will has been duly proved, and should be allowed as the last will and testament of said Henry Muller, deceased. It is therefore considered by me that said last will and testament was duly executed, and that the same is genuine and valid, and that said last will and testament be admitted to probate and established as a will of real and personal estate. And it is further ordered that letters testamentary issue thereon to Henry Ellinghausen upon his giving bond in the sum of $5000.00 and taking the oath required by law.

Last Will and Testament.
In the name of God, Amen: I Henry Muller of the Township of Cuming, in the County of Cuming, and State of Nebraska, considering the uncertainly of this mortal life, and being of sound and disposing mind, blessed be God for the same, do make, publish and declare this my last will and testament, in manner and form following, that is to say:
First. I direct that my funeral charges, the expenses of administering my estate and all my just and lawful debts, be first paid by my executor hereinafter mentioned.
Second. I give and bequeath to my son Henry Muller, of Scribner, Nebraska, the sum of Five ($5.00) Dollars and no more, for the reason that he has received his share from me during my lifetime, and said sum of $5.00 to be paid to him by my wife, as hereinafter provided.
Third. I give an bequeath to my son George Muller, of Scribner, Nebraska, the sum of ($5.00) Five Dollars, and no more, for the reason that he has received his share from me during my lifetime: and sum of $5.00 to be paid to him by my wife, as hereinafter provided.
Fourth. I give and bequeath to my son Herman Muller, of Concord, Dixon County, Nebraska, the sum of Five ($5.00) Dollars, and no more, for the reason that he has received his share from me during my lifetime; said sum of $5.00 to be paid to him by my wife as hereinafter provided.
Fifth. I give and bequeath to my daughter, Katie Hasemann of Scribner, Nebraska, the sum of Three Thousand ($3000.00) Dollars; said sum to be paid to her by my wife as hereinafter directed.
Sixth. I give and bequeath to my son, Fritz Muller, of Wakefield, Nebraska, the sum of Three Thousand ($3000.00) Dollars: said sum to be paid to him by my wife as hereinafter directed.
Seventh: I give and bequeath to my son, Adolph Muller, of Scribner, Nebraska, the sum of Three Thousand ($3000.00) Dollars: the same to be paid to him by my wife as hereinafter directed.
Eighth. I give and bequeath to my beloved wife, Christina Muller, all the rest and residue of my personal property, and I do further devise and bequeath to her all of the following described real estate to-wit: The South East Quarter of the South East Quarter of Section Thirty Two (32) and the East Half of the South West Quarter and the West Half of the South East Quarter in Section Thirty Three (33) all in Township Twenty One (21), Range Seven (7), East, in Cuming County, State of Nebraska; also the South East Quarter of Section Five (5) in Township Twenty Seven (27) Range Five (5) East, in Dixon County, State of Nebraska: the said property to be and to belong to my said wife, Christina Muller in fee simple forever: provided however, and upon the one condition, namely that she pay the legacies to my children, as mentioned in paragraphs "Second," Third" "Fourth" "Fifth" "Sixth" and "Seventh" of this my will; and I do further expressly direct and order that these legacies mentioned in Paragraphs, "Second" "Third" Fourth" "Fifth" "Sixth" and "Seventh" of this my will, and to be paid by my beloved wife Christina Muller, are payable at any time at the option of my said wife and shall not bear any interest. This is done by me for the reason that I wish my wife to have all the time she desires to pay said legacies; and in case said legacies or any of them are not paid at the time of her death then said legacies or so many of them as remain unpaid shall be a charge against the estate of my wife, Christina Muller, and to remain so, until paid.
Ninth. I nominate and appoint my friend and neighbor Henry Ellinghausen, executor of this my last will and testament, hereby revoking all former wills by me made.
In witness Whereof, I have hereunto set my hand this 4th day of April A. D., 1912.
