Jacob W. Cline and Clark Cline, having on the twenty-ninth day of December A.D. Eighteen Hundred and ninety seven, presented to the Surrogate of the County of Warren, a paper writing purporting to be the Last Will and Testament of Jacob Carhart late of the County of Warren, deceased in and by which the said Jacob W. Cline and Clark Cline are named as the executors thereof, and the said Jacob W. Cline and Clark Cline, having applied for the probate of said paper writing, as and for the last will and testament of said decedent, and for letters testamentary thereon, and which said paper writing and the proofs thereof are as follows. That is to say:
In the name of God. Amen.
I Jacob Carhart, of Harmony township, Warren County, New Jersey, being of sound mind, memory and understanding, do make this my last will and testament, as follows:
First: I order and direct that all my just debts and funeral expenses be duly paid and satisfied, and that a suitable monument, or head stones be erected in my plot in the Upper Harmony Cemetery over the graves of myself and wife, as may be deemed necessary at a cost not to exceed four hundred dollars.
Item: All the household furniture, goods and chattels in the house and on the premises where I now live, I give and bequeath to my wife Elvira Carhart to be hers forever.
Item: Also I give and bequeath to my beloved wife Elvira Carhart the use, income and benefit of the house and lot and premises where I now live so long as she lives and remains my widow.
Also I order and direct that the sum of six thousand dollars in money or bank stock, as she may desire, be set apart and invested in bank stock or safe investments, and that my beloved wife Elvira Carhart receive the income, interest and benefit from said sum of six thousand dollars as the said dividends and income and interest shall become due, or yearly, so long as she lives and remains my widow.
All the above bequests I give and bequeath to my beloved wife Elvira Carhart in lieu of her right of dower in my estate.
Item: I give devise and bequeath the house and lot and premises where I live containing about twenty acres with the appurtenances to my niece, Edna H. Cline, daughter of my sister Susan H. Cline, to be hers and her heirs and assigns forever in fee simple, subject however to my beloved wife having the use and possession of the same so long as she lives and remains my widow; and after the death of my said wife then the said Edna H. Cline, to be and become fully seized of the possession, and right and title to said lot full and absolutely the same as I hold the same.
Item: I give and bequeath to my nephew Charles Carhart, four hundred dollars in cash.
Also I give and bequeath to my nephew William Carhart, four hundred dollars in cash.
I mean by the above named Charles and William, the sons of my brother John Carhart, deceased, and give to them each the sum of four hundred dollars as said above.
Item: Also I give and bequeath to the five children of my brother Thomas F. Carhart dec'd, the sum of two thousand dollars, the same to be divided among the said five share and share alike, or to the heirs of any that may be dead at the time of such distribution.
I direct that my farm at Lower Harmony be sold by my Executors at such time, and in such manner as may be deemed best for the interest of my Estate and at either public or private sale; and after selling apart the said sum of six thousand dollars for the benefit of my wife as above provided, and paying all my debts and funeral expenses, and the above mentioned legacies amounting to twenty eight hundred dollars then all the rest and residue of the property real or personal or mixed that I shall die seized or possessed of (excepting out also the lot given to Edna H. Cline), I order and direct to be equally divided share and share alike between my three sisters, Elizabeth Oberly, Lydia Raub, and Susan H. Cline, or their heirs, also the said sum of Six thousand dollars set apart for my wife's benefit, after her death I order the said sum of Six thousand dollars to be equally divided between my said three sisters, or their heirs, the children of each sister taking the parents' share.
I give and bequeath to my namesake Jacob Carhart Martenis the sum of one hundred dollars in cash, to be paid over to his father, who I appoint trustee for the purpose of holding the same for him, the same to be used for the benefit of said Jacob C. Martenis, and I request my said namesake to make good use of the money I leave him: the said one hundred dollars to be taken out of my Estate.
I direct that in case any Collateral inheritance tax is assessed or charged against the lot bequeathed to Edna H. Cline, that the amount of said tax be paid out of my estate as a debt, by my said Executors so that she may have the said lot clear of all encumbrance.
Lastly I hereby appoint my brother-in-law Jacob W. Cline, and my nephew Clark Cline the Executors of this my last will and testament, and give them full power to settle up my estate, without giving any security and I also give them full power to sell my said farm as above set forth, and empower them to give a good deed of conveyance for the same to the purchaser, the same as I might do if living.
In witness whereof I have hereto set my hand and seal this twentieth day of October in the year of our Lord one thousand eight hundred and ninety-seven.

Sealed, signed, published and declared by the above named Jacob Carhart to be his last will and testament, in the presence of us, who were present at the same time, and have subscribed our names as witnesses thereto in the presence of the testator and each other at his request.

Jacob W. Cline and Clark Cline, the Executors in the within testament named, being duly sworn on their oath did each depose and say that the writhin instrument contains the true last will and testament of Jacob Carhart the testator therein named, so far as they know, and as they verily believe: that they will well and truly perform the same by paying first the debts of the said deceased, and then the legacies in the testament specified, so far as goods, chattels and credits of the said deceased can thereunto extend, and that they will make and exhibit into the Surrogates' office at Belvidere, in the County of Warren, a true and perfect inventory of all and singular the goods, chattels and credits of the said deceased that have or shall come to their knowledge or possession, or to the possession of any other person for their use and render a just and true account when thereunto lawfully required, and that the said Jacob Carhart died on the Fourteenth day of December A.D. 1897.
