The Last Will and Testament of Henry Carhart
Proved and recorded the 29th day of October 1871, as a will of real and personal estates.
In the name of God, Amen. I, Henry Carhart of the town of Guilderland in the County of Albany and in the State of New York and in the seventy seventh year of my age mindful of the uncertainty of life do make publish and declare this my last will and testament in manner following hereby revoking all former wills by me made.
First.
I give and bequeath to my wife Eliza one third of the income of my farm now owned by me situated in the town and county aforesaid near Fuller? Station also such part of the house on such premises as she sees fit to choose not to exceed one half of the same in lieu of dower.
I also give and bequeath to my Wife Eliza all household furniture, beds and bedding forever.
Second.
I give and bequeath to my son Robert S. Carhart all my real estate also all farming implements of every kind also all stock of every kind and I declare that my son Robert S. Carhart is to pay legacies third and fourth hereinafter mentioned.
Third.
I give and bequeath to my daughter Catharine R. Ward the sum of five hundred dollars to be paid by my son Robert S. Carhart.
Fourth.
I give and bequeath to my niece Kathy M. Weaver the sum of three hundred dollars to be paid by my son Robert S. Carhart.
Fifth.
I give and bequeath if there be any to my daughter Catharine R. Ward and my niece Kathy M. Weaver all cash, notes, or mortgages share and share alike.
I hereby nominate and appoint my son Robert S. Carhart executor and my daughter Catharine R. Ward executrix of this my last will and testament.
In witness whereof I have hereunto set my hand and seal this 2nd day of February in the year of our Lord 1883.

The above instrument written on three sheet of legal cap paper was signed published and declared by the said testator to be his last will and testament in the presence of us who have signed our names at his request as witnesses in his presence and in the presence of each other.

Aaron Fuller of the town of Guilderland in the County of Albany N.Y. and John F. Blessing of the town of Guilderland in the County of Albany, N.Y. being first duly sworn in open court, do depose and say, and each for himself deposeth and saith that he is a subscribing witness to the instrument now shown to him, purporting to be the last will and testament of Henry Carhart of the town of Guilderland in the County of Albany. That the said Henry Carhart did in the presence of this deponent subscribe his name at the end of the instrument which is now shown and exhibited to this deponent and aforesaid, and which purports to be the last will and testament of the said Henry Carhart and which bears date on the 2nd day of Feburary in the year of our Lord One Thousand eight hundred and eighty three and this deponent further saith that the said Henry Carhart the said testator did at the same time of subscribing his name as aforesaid at the end of the said will, declare the said instrument so subscribed, and now exhibited, to be his last will and testament; and this deponent did thereupon subscribe his name at the end of the said will, as an attesting witness thereto in the presence of and at the request of the said testator, and this deponent further saith, that at the said time when the said testator subscribed his name to the said last will as aforesaid, and at the time of the deponent subscribing his name as an attesting witness thereto as aforesaid, the said Henry Carhart was of sound mind and memory, of full age to execute a will, and was not under any restraint to the knowledge, information or belief of this deponent, and futher these deponents say not.
